“Lucky U” Tack Room Makeover

DATES/OVERVIEW: This promotion is a combination of a random drawing and skill contest (the “Promotion”), which begins at 12:01 AM Eastern Time (ET) on August 1, 2007, and ends at 11:59 PM ET on March 31, 2008 (the “Promotion Period”). Five (5) Participants will be randomly selected to participate in the “Lucky U” Tack Room Makeover contest where they will submit a written narrative to describe why they deserve a Tack Room Makeover along with at least one photograph of their existing tack room or tack area.

ELIGIBILITY: To be eligible for the Tack Room Makeover you must own real property, have at least one horse, and a minimum of one (1) horse stall located on the property. You must be 21 years of age at time of entry and a legal US resident, who resides in one of the specific States, Parishes, or Counties, as described below.

All residents of the following States: Alabama, Delaware, Florida, North Carolina, South Carolina, Mississippi, Virginia, West Virginia, Maryland, Pennsylvania and Georgia.

Residents of Louisiana, who reside in one of the following Parishes: Acadia, Allen, Ascension, Assumption, Avoyelles, Beauregard, Calcasieu, Caldwell, Cameron, Catahoula, Concordia, East Baton Rouge, East Carroll, East Feliciana, Evangeline, Franklin, Grant, Iberia, Iberville, Jefferson, Jefferson Davis, Lafayette, Lafourche, LaSalle, Livingston, Madison , Morehouse, Natchitoches, Orleans, Plaquemines, Pointe Coupee, Rapides, Richland, Sabine, St. Bernard, St. Charles, St. Helena, St. James, St. John the Baptist, St. Landry, St. Martin, St. Mary, St. Tammany, Tangipahoa, Tensas, Terrebonne, Vermilion, Vernon, Washington, West Baton Rouge, West Carroll, West Feliciana, and Winn.

Residents of Tennessee who reside in one of the following Counties: Marion, Hamilton, Bradley, Polk, Sequatchie, Bledsoe, Rhea, Meigs, Roane, Loudon, McMinn and Monroe

Residents of Kentucky who reside in one of the following Counties: Ballard, McCracken, Marshall, Carlisle, Hickman, Fulton, Graves, Calloway, Harrison, Scott, Bourbon, Montgomery, Clark, Fayette, Franklin, Marion, Washington, Anderson, Woodford, Mercer, Boyle, Jessamine, Madison, Garrard, and Lincoln.

Residents of Ohio who reside in one of the following Counties: Crawford, Erie, Hancock, Hardin, Henry, Huron, Lorain, Lucas, Marion, Morrow, Paulding, Putnam, Sandusky, Seneca, Van Wert, Wyandot, and Wood.

The following are not eligible to participate: a) officers, directors, and employees of AgFirst Farm Credit Bank (the “Sponsor”), its affiliated Farm Credit System lending associations, advertising and promotion agencies affiliated with the Sponsor, and any other party that is directly involved with the development or implementation of this Promotion; and b) the immediate family members (spouse, parents, children, siblings, and their respective spouses) of employees and household members with whom they may reside (whether related or not).

THERE ARE 2 WAYS TO ENTER: (1) Online. You may visit www.tackroommakeover.com during the Promotion Period and complete and submit the Official Online Entry Form. To complete the Official Online Entry Form, Entrants must include their complete name, address including zip code and County/Parish, primary and secondary phone numbers, E-mail address (if available), and birth date. All entries must be received by 11:59 PM ET on March 31, 2008. Online entries are deemed made by the authorized account holder of the email address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an email address by an Internet access provider, service provider or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Potential winner may be required to show proof of being the authorized account holder. (2) By Mail. You may also enter the Promotion, by hand-printing, on a 3” x 5” card or piece of paper, your complete name, address, primary phone number, email address (if available), County/Parish and birth date. Enclose this in a hand-addressed #10 business-size envelope and mail to: Tack Room Makeover, 625 Panorama Trail, Bldg. 2 Suite 100, Rochester, NY 14625.
Limit: one entry per person or E-mail address. Entries become the sole property of the Sponsor and will not be acknowledged or returned. Sponsor is not responsible for lost, stolen, illegible, postage-due, late, incomplete, misdirected entries, or those that are lost due to computer or electronic malfunction or other error. Entries not complying in any way with these criteria are subject to disqualification. All entries submitted become the sole property of the Sponsor.

SELECTION OF PROMOTION FINALISTS: Five (5) Finalists will be selected in a random drawing from among all eligible entries received. The random drawing will be conducted on or about April 1, 2008 by an Independent Promotion Administrator (“IPA”), whose decisions in all matters relating to this Promotion are final and binding. Odds of an Entrant being selected as a Finalist will depend on the total number of eligible entries received. The Sponsor or IPA will attempt to contact each potential finalist via telephone within 24 hours from the time of winner selection. If Sponsor or IPA is unable to reach a potential finalist within 48 hours, an alternate potential winner will be selected. Each Finalist will be invited to participate in a skill-based Contest.

THE “CONTEST”: The eligible Finalists will then be required to submit a written narrative consisting of no more than 250 words (narrative), on why they need or deserve a tack room makeover and must submit at least one photo of their existing tack room or tack area (photograph will not be judged) (the “Contest”). If, at that point, examination of the photo reveals that the finalist does not meet the eligibility requirements, they will be disqualified, and another potential finalist name will be drawn. Entrants will be given 30 days to submit their narrative and photograph. A limit of three photographs will be accepted. Arrangements can also be made with the Sponsor for the Sponsor’s representative to take the photo for the Finalists upon a Finalist’s request to the Sponsor or IPA at the time the Finalist is contacted.

JUDGING: The five narratives submitted by the Finalists will be judged using the following criteria: (a) creativity (33%), (b) originality (33%), and (c) relevance to theme (34%). The narrative submitted by the Finalist, with the highest overall score, will be declared the Grand Prize Winner. In the event of a tie, the “relevance to theme” criteria will be used to determine the winner. The decisions of the Sponsor, on all matters relating to this Contest, are final and binding. Grand Prize Winner will be selected on/about June 1, 2008. Winners will be notified by telephone, mail or e-mail. If Sponsor cannot contact a potential winner within fourteen (14) days or if the prize-winning notification or a prize is returned as undeliverable, the prize will be forfeited and may be awarded to an alternate winner.

PRIZES: The Grand Prize Winner will receive a Tack Room Makeover. The Makeover is defined as a plan and design for reorganization of the existing tack room or tack area including the addition of organizational tools, equipment or other items such as, but not limited to: hooks, racks, shelving, and storage bins. The Makeover does not include any type of structural work, such as, but not limited to: adding or removing walls or any other construction work. The Tack Room Makeover has an Approximate Retail Value (ARV) of up to $5000. The remaining four (4) Finalists will each be awarded a $250 Gift Card to a national home improvement chain which will be determined by the Sponsor in its sole discretion.

Total ARV of all prizes to be awarded is $6000.

CONTEST TERMS & CONDITIONS: Upon receipt, all submissions become the property of the Sponsor, its successors and/or assigns and may be used, or not used, by Sponsor as Sponsor sees fit, in any and all media, now known or hereafter developed, without limitation of any kind, including any limitation as to time, territory or medium, and may be copyrighted, or otherwise protected at law, by Sponsor, all at Sponsor’s sole discretion. Accordingly, no submission will be returned. Upon receipt, all submissions will be reviewed by the judges selected by Sponsor and all decisions of the judges shall be final and binding. By submitting a narrative for review, in connection with the Contest, each individual submitting same, irrevocably represents and warrants to Sponsor that the entry is entirely her or his own original work. By submitting the narrative for consideration by the Sponsor as contemplated herein, the submitter irrevocably for herself, or himself, or their heirs or successors, releases and holds harmless the Sponsor, its officers, employees, agents and directors, from and against any and all claims the submitter, or its successors, may have against Sponsor, arising from Sponsor’s use of any entry, material or information contained related to or contained therein, or otherwise, in connection with the subject Contest and Promotion or Sponsor’s use or exploitation of submitted materials, data or information.

Grand Prize Winner and the four (4) Finalists will be required to sign and return an executed Affidavit of Eligibility and Liability/Publicity Release within 7 days of receipt of notification, or the prize may be forfeited and another winner selected. Return of any prize notification as undeliverable will result in disqualification and an alternate winner selected. All federal, state, and local laws apply. Winners are solely responsible for all federal, state and local taxes, and insurance on prize, if applicable. Winners consent to the use of their name, narrative, photo(s), and likeness for advertising and promotional purposes for no additional compensation (except residents of TN). By entering, each Finalist gives Sponsor the right to utilize the submitted narrative and photographs in Sponsor’s future marketing and promotional efforts without any further compensation or release.

LIMITATIONS OF LIABILITY: Entrants agree to release, discharge, indemnify and hold harmless the Promotion entities, and each of their respective officers, directors, employees, representatives and agents from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize awarded, or participation in this Promotion. Sponsor and their agents are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with, or utilized in, this Promotion, or by any technical or human error which may occur in the processing and/or transmissions in the Promotion. Sponsor, and their agents assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of, entries, nor for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of e-mail due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person’s computer related to, or resulting from, participating or downloading materials in this Promotion. If, for any reason, the Promotion is not capable of running as planned, including, without limitation, infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion, and select winners from all entries received up to the time of termination. Entrants waive the right to claim any damages whatsoever, including, without limitation, punitive, consequential, direct or indirect damages.

DIRECT MARKETING: By entering the Promotion, Entrants acknowledge that they may receive various marketing or other information from the Sponsor or its affiliated lending associations regarding their products or services. If an Entrant does not desire to receive this information, an Entrant may opt out by notifying the Sponsor by
